Participant(s) in horseback riding activities at Our Red Barn Ranch must acknowledge and agree to the following terms and conditions in consideration of being permitted to engage in horseback riding activities at Our Red Barn Ranch, LLC, located in Calhan, Colorado.

  1. Assumption of Risk: I understand that horseback riding involves inherent risks, including but not limited to, the risk of injury or death resulting from the unpredictable behavior of horses, the terrain, and other participants. I acknowledge that these risks cannot be eliminated despite the exercise of due care by Our Red Barn Ranch, LLC.
  2. Safety Equipment: I agree to wear appropriate safety equipment provided by Our Red Barn Ranch, LLC during all horseback riding activities, including but not limited to, helmets and appropriate footwear.
  3. Medical Condition: I certify that I am in good physical condition and do not have any medical conditions that would prevent me from safely participating in horseback riding activities. I agree to disclose any medical conditions or concerns to Our Red Barn Ranch, LLC prior to engaging in any activities.
  4. Release of Liability: I hereby release, waive, discharge, and covenant not to sue Our Red Barn Ranch, LLC , its owners, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me while participating in horseback riding activities, whether caused by the negligence of Our Red Barn Ranch, LLC or otherwise.
  5. Indemnification: I agree to indemnify and hold harmless Our Red Barn Ranch, LLC , its owners, employees, agents, and representatives from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees arising out of or in any way related to my participation in horseback riding activities. Our Red Barn Ranch, LLC.
  6. Photographic Release: I consent to the use of any photographs, video recordings, or other media taken of me during horseback riding activities by Our Red Barn Ranch, LLC for promotional, advertising, or other purposes without compensation to me.
  7. Governing Law: This waiver shall be governed by and construed in accordance with the laws of the State of Colorado.

I have read this waiver form in its entirety and fully understand its contents. I voluntarily agree to its terms and conditions and acknowledge that I have given up substantial rights by signing it. I also understand that this waiver shall be binding upon my heirs, executors, administrators, and assigns.
